Important Disclosures

These Important Disclosures explain what Cheetah Technologies LLC ("Cheetah Technologies", "we" or "us") and its product Cheetah OS (the "Service") are, and what they are not. They form part of the Terms of Service. If you are a merchant, investor or other person who has been invited to use Cheetah OS by one of our customers, these disclosures also explain our role in your relationship with that customer.
1. What Cheetah Technologies Is
Cheetah Technologies is a software company. Cheetah OS is business software for commercial finance professionals, including brokers and ISOs, merchant cash advance providers and other business funders, underwriters, and syndicators and investors, and their staff. Our customers use it to manage leads and deals, communicate with merchants, collect documents, underwrite, submit deals to funders, sign agreements, track commissions, record syndication participations and distributions, and track collections and renewals. We sell it to businesses only. It is not offered to consumers.
2. What Cheetah Technologies Is Not
Cheetah Technologies does not lend, broker, arrange, or fund any financing, and it is not a party to any financing transaction between our customers and their merchants, funders or investors. Specifically, Cheetah Technologies is not:
- a lender, creditor, funder, or purchaser of receivables;
- a loan broker, ISO, commercial financing broker, or arranger of financing, and it does not solicit, negotiate, introduce, refer or place any deal;
- a bank, money transmitter, payment processor, or escrow agent, and it does not receive, hold, transmit, disburse or control money belonging to customers, merchants, investors or anyone else;
- a consumer reporting agency, and it does not furnish consumer reports;
- a broker-dealer, funding portal, investment adviser, placement agent, or transfer agent;
- a debt collector, payroll provider, professional employer organization, or tax return preparer; or
- a law firm, accounting firm, or compliance consultant.
A customer that uses Cheetah OS is responsible for its own products, decisions, disclosures, licenses and conduct. If you have a question or complaint about a financing offer, a deal, a payment, a collection, or an investment, contact the business you are dealing with.
3. How We Are Paid
We charge our customers flat subscription fees and usage-based fees (such as seats, calling minutes, text messages and AI usage). We never charge any fee that depends on whether a deal is approved or funded, on the amount funded, on capital raised, on distributions paid, or on any other transaction outcome. Our pricing gives us no financial interest in the outcome of any deal.
4. No Legal, Tax, Credit, Investment or Compliance Advice
Nothing in the Service, on our website, in our templates, calculators, checklists, help content or AI outputs, or in communications from our staff is legal, tax, accounting, credit, investment or compliance advice. Features that help with disclosures, consent, quiet hours, opt-outs, recording announcements, record keeping and similar tasks are tools. They do not guarantee that any activity is lawful, and laws vary by state and country and change often. Customers must obtain their own professional advice and review every template, disclosure and calculation before using it.
5. No Guarantee of Funding or Results
Using Cheetah OS does not guarantee that any merchant will be approved or funded, that any deal will close, that any investor will participate, that any communication will be delivered, or that a customer will achieve any level of revenue, volume, efficiency or other result. Decisions about financing are made by our customers and their funders, not by us.
6. Fraud and Risk Signals Are Informational
We are developing document integrity and fraud signal features that are not yet available. If and when we release them:
- they will produce informational indicators only, such as a sign that a document may have been altered or that details appear inconsistent;
- signals can be wrong, including flagging legitimate documents (false positives) and missing problems (false negatives);
- a signal is never an automated decision to approve, decline or price anything, and every signal must be reviewed by a qualified person before any action is taken;
- signals will be based on the data in the customer's own account, not on a shared database of other customers' merchants, guarantors or deals; and
- signals are not consumer reports and must not be used as the basis for credit, employment, insurance or other eligibility decisions about individuals in a way that would require a consumer report.
A signal is not an accusation. No one should be treated as having committed fraud because of a signal alone.
7. AI Outputs May Be Wrong
Cheetah OS includes an AI assistant powered by third-party large language model providers, and we plan additional AI features. AI outputs are generated by probability, not by verified knowledge. They can be inaccurate, incomplete, out of date or inconsistent, and they can sound confident when they are wrong. AI outputs are not advice and are not decisions. Customers must review AI outputs before relying on them or sending them to anyone, and must keep a person responsible for every decision about credit, funding, employment or other significant matters. We do not use customer data to train AI models, and we require our AI providers not to either. See our AI Terms.
When AI voice agents become available, every AI call must identify itself as an automated AI assistant at the start.
8. Investor and Syndication Module
8.1 Record keeping only
The investor and syndication module records participations, commitments, allocations and distributions that our customers configure and enter, and lets customers share reports with investors they invite. It does not hold, move, pool or disburse money. Any payment to or from an investor is made by the customer, its bank, or its own payment provider.
8.2 Not a securities offering platform
Cheetah OS is not a securities offering platform, marketplace, funding portal or broker-dealer. Cheetah Technologies does not offer, sell, solicit, recommend or endorse any security, participation or investment; does not match investors with deals; does not verify whether any investor is accredited; does not review or approve any offering materials; and receives no compensation tied to any investment. Nothing displayed in the module is an offer to sell or a solicitation of an offer to buy any security.
8.3 Customers are responsible for securities compliance
Participations in merchant cash advances and similar syndication interests may be securities. Each customer is solely responsible for determining whether its interests are securities and for complying with federal and state securities laws, including Regulation D, Form D and state notice filings, the limits on general solicitation, accredited investor verification, broker-dealer and investment adviser registration of anyone it pays to raise money or give advice, offering disclosures, and record keeping.
8.4 For investors
If you are an investor invited to view reports in Cheetah OS, the information you see is provided by the customer that invited you, not by Cheetah Technologies. We do not verify it. Any investment involves risk, including the loss of your entire investment. Direct any questions about your investment to the business you invested with, and consider getting independent advice.
9. State Commercial Financing Laws Bind Our Customers
A growing number of states, including California, New York, Utah, Virginia, Florida, Georgia, Connecticut, Kansas, Missouri, Louisiana and Texas, regulate commercial financing through disclosure requirements, provider and broker registration, advertising rules, restrictions on confessions of judgment, and other rules. Those laws apply to our customers, the providers and brokers of financing, not to Cheetah Technologies as a software vendor. Where Cheetah OS helps prepare a disclosure or calculates an estimated figure, the customer chooses the state and settings, must verify the output, and is responsible for its accuracy and delivery.
10. Communications Compliance Tools
Cheetah OS includes safeguards for calling, texting, email and recording, such as quiet hours, frequency limits, opt-out handling and recording announcements, as described in our Calling, Texting, Email and Recording Rules. These safeguards reduce risk but do not make any communication lawful. Our customers are the callers and senders and are responsible for consent, do not call compliance, registrations and content. If you received an unwanted call, text or email from a business that uses Cheetah OS, you may tell that business to stop, and you may also report it to info@cheetahos.app.
11. Security Statements
We describe our security measures in the Terms of Service, our Privacy Policy and our Data Processing Addendum. Current measures include per-tenant encryption keys, field-level encryption of sensitive fields, a tamper-evident audit log, passkey and time-based one-time password multi-factor authentication (mandatory for our internal staff roles), bot protection, malware scanning of uploads, and screening against known breached passwords. We do not claim SOC 2 or any other security certification or audit report, and we do not describe our security as "bank-level" or "military-grade". If we obtain an independent audit report in the future, we will state its type, scope, auditor and period. No system is perfectly secure.
12. Accessibility
We are working to make Cheetah OS and our website accessible, targeting the Web Content Accessibility Guidelines (WCAG) 2.2 at level AA. We do not claim that our website or the Service is fully accessible or "ADA compliant". Our current status and how to request help are described in our Accessibility Statement.
13. Marketing Claims, Statistics and Testimonials
- Statistics and industry figures on our website are drawn from the sources cited next to them, as of the date stated. Where a figure is our own estimate or target, we say so. [[FILL: confirm every statistic on the site has a cited source and date.]]
- Product capability claims, including claims about AI features, are based on our own testing of the Service as of the date the claim was made. Results in your business may differ.
- Testimonials and case studies, if any, are from real customers, are used with their written permission, and reflect their own experiences. They are not typical results unless stated. If a customer received anything of value connected to a testimonial (such as a discount, free service or a referral payment) we will disclose it next to the testimonial. We do not publish fabricated, composite or AI-generated testimonials.
- Comparisons with other products are based on publicly available information as of the date stated, and may change.
- Trademarks of other companies mentioned on our website belong to their owners. Their use does not imply any affiliation with or endorsement by them.
14. Pre-Launch Status
Cheetah OS is in a pre-launch stage. Features, plan contents and prices described on our website are launch targets and may change before general availability. Some features described on our website or in these documents are planned and not yet available, including document integrity and fraud signals, AI voice agents, verified bank data connections, point-of-sale connectors, a public API and webhooks, and an embeddable partner widget. We do not promise that any planned feature will be released or released on any timetable. Demo accounts use synthetic (fictional) data. Nothing in a demo represents a real merchant, deal, investor or result.
15. Third Parties
Cheetah OS works with third-party services, including our telephony carrier Telnyx, Stripe for payments, email providers, AI model providers and others listed on our Subprocessor List. We do not endorse, and are not responsible for, any third party's products, services, terms or conduct. We do not vet, license, endorse or recommend any of our customers, or any funder, broker, merchant or investor that uses or is invited to Cheetah OS. The presence of a business on our platform is not a statement about its licensing, reputation, financial condition or compliance.
16. Links to Other Websites
Our website and the Service may link to websites operated by others. We provide links for convenience only, do not control those websites, and are not responsible for their content, accuracy, privacy practices or availability. A link is not an endorsement.
17. United Kingdom
Cheetah OS is not yet available in the United Kingdom. When it is, the following will also apply. Cheetah Technologies is not authorised or regulated by the Financial Conduct Authority. We do not introduce, arrange, advise on, provide or collect credit, we do not operate an electronic lending platform, and we do not provide credit references. Nothing on our website is a financial promotion or an invitation to obtain finance or to invest. UK customers are responsible for their own FCA permissions and for any financial promotion they communicate.
